Martial arts: Military claims

Many people falsely claim military service, including some martial artists. Pseudo-masters don't just claim false military service, since they are so "special," they falsely claim high rank, awards, and membership in elite forces, such as Seals or Recon. The following provides some information that may help you sort out the truth about military service claims.

What is a veteran?

A veteran is a person who served in the armed forces and received an honorable discharge, no matter the length of service. Thus, a veteran may have served less than a year or more than 30 years. A service person may receive an honorable discharge for each completed term of service, so a person may have one or more honorable discharges before finally receiving a less than honorable discharge. Therefore, anyone with at least one honorable discharge may claim to be a veteran. This person may still be classified as a veteran by the government, but amongst veterans, the person is a disgrace. Legally, anyone may claim to be a veteran as long as the claim is not used to gain a veteran benefit.

What is a war veteran?

Officially, veteran of a war is any person who served honorably during the war, whether in the theater of combat or not. For example, anyone who served honorably during the Vietnam War is officially a Vietnam War veteran. Therefore, a person may legally claim to be a Vietnam War veteran even though he or she never served outside the United States. For example, in North Carolina, anyone who served during the Vietnam War may qualify for a Vietnam Veteran vehicle license plate. However, amongst military personnel and veterans, this is not the case; they make a distinction between serving during the time of a war and serving in the war.

Military awards

Under current law, it is illegal to wear any military decoration that you have not been officially issued, but it is not illegal to claim to have earned a decoration that you were never officially issued. It is against the law to manufacture, wear, buy, sell, or trade the Medal of Honor,; however, other medals are routinely and legally made, sold, and bought.

Special Forces

Veterans who served in the special forces, such as Navy Seals, Marine Recon, Army Rangers, etc. will have this designation noted on their DD-214 Block 13- Decorations, Medals, Citations, and Campaign Ribbons Awarded or Authorized. Seals must complete Basic Underwater Demolition/SEAL (BUD/S) training. BUD/S training is not secret. Any Seal will know his BUD/S company number and other members of that company.

Are false claims unlawful?

The Stolen Valor Act of 2005, signed into law by President George W. Bush on December 20, 2006, broadened the provisions of previous U.S. law addressing the unauthorized wear, manufacture, or sale of anymilitary decorations and medals. It made it a federal misdemeanor to falsely represent oneself as having received any U.S. military decoration or medal. If convicted, defendants might have been imprisoned for up to six months, unless the decoration lied about is the Medal of Honor, in which case imprisonment could have been up to one year. In United States v. Alvarez the U.S. Supreme Court ruled on June 28, 2012, that the Stolen Valor Act was an unconstitutional abridgment of the freedom of speech under the First Amendment, striking down the law in a 6 to 3 decision.

As the law currently stands, anyone may claim to be a veteran, a war veteran, an ex SEAL, an ex military martial art instructor, a medal winner, or practically anything else without breaking any law, so be aware of false claims by martial art “masters.” While in the Navy, I taught taekwondo on a naval base to naval personnel with the approval of the navy; however, that does not mean I was a Navy martial arts instructor. If some of my students were SEALs, but that does not mean I was a martial arts instructor for the SEALs.

Verification

If you really want to verify a person's military service claims, you could request to see their DD-214 (see below). You do not have to request proof of claims from a “master” to verify them. During normal conversation with the “master,” ask questions that a legitimate claimant should know, listen to the “war stories” to see is they seem authentic and whether they change each time they are told, listen to whether the claimant is using the correct terminology that a ex-military person would or should use or know, and ask questions about the area in which the person claimed to have served. Then judge for yourself if you think the person fits the character and personality of what you believe a person of the claimed military status should possess.

valor.defense.gov, also called U.S. Military Awards for Valor, is a website published by the United States Department of Defense to track recipients of awards and decorations of the United States military. It currently contains the complete list of Medal of Honor recipients for actions since the September 11, 2001 attacks.

DD-214 Certificate of Release or Discharge from Active Duty

The DD Form 214, usually referred to as the DD214, is a United Sates Department of Defense document issued upon a military service member's retirement, separation or discharge from active military duty. EVERY prior military person was issued a DD Form 214 upon separation. If it lost, the member may request a copy from the National Personnel Records Center.

There are 8 copies of the original DD Form 214; the two issued to members are the Member 1 copy, usually referred to as the "short copy," which omits the characterization of service and reason for discharge, and the Member 4 copy (if requested), usually referred to as the "long copy," which incudes the characterization of service and reason for discharge. Therefore, a person who does not want you see his or her reason for separation or discharge will only show you the Member 1 short copy.

The DD Form 214N Report of Separation From Active Duty is issued when the member is immediately reenlising after completion of an enlistment.

Be careful, like everything else, DD-214 may be altered or complete fakes.

The following items are shown on the DD-214 Member 4 long form but are omitted from the Member 1 short form.

Block 23. Type of Separation

Provides the type of separation, such as discharge, retirement, transfer to reserves, etc.

Block 24. Character of Service

Provides the character of service:

• Honorable. To receive an honorable discharge, you must have received a rating from good to excellent for your service. Even though you may only qualify for a general discharge, you may receive an honorable discharge under two circumstances:
  • When you are separated because of a disability incurred in the line of duty.
  • When you receive any awards for gallantry in action, heroism, or other meritorious service.

• General (under honorable conditions). You receive a general discharge when you separate from the service, under honorable conditions, without a sufficiently meritorious military record to deserve an honorable discharge. This means that, although you have not been in any serious trouble, you just cannot “hack it” in the military or maintain its standards of conduct or professionalism. Some think because a general discharge is given under honorable conditions, it is as good as the honorable discharge itself. However, it is not. A general discharge indicates satisfactory service but not to the established standard of the military. After this point, you can say you were once in the military service, but you are not considered a veteran.

• Other than honorable (OTH). You receive an other than honorable discharge for misconduct or security reasons. This discharge may be issued administratively without approval of a general or a special court-martial.

• Bad conduct (BCD). You receive a bad conduct discharge when you separate from the service under conditions other than honorable. It may only be issued as a part of an approved sentence of a general or a special court-martial, which is equivalent to a federal criminal conviction.

• Dishonorable (DD). You receive a dishonorable discharge when you separate from the service under dishonorable conditions. It may only be issued as a part of an approved sentence of a general or a special court-martial, which is equivalent to a federal criminal conviction.

Block 25. Separation Authority

Provides the regulation that authorizes the separation, such as MILPERSMAN 3855180.

Block 26. Separation Code

The separation code provides the reason the separation. These codes are subject to change, and the Department of Defense will no longer allow the military services to release the meanings of these codes to the general public. The below definitions were obtained before this prohibition went into effect.

Block 27. Reentry Code

The reentry/reenlistment (RE) code provides information about the member's ability to reenlist in the armed services. The codes and the ability to reenlist vary from service to service. For example, a sailor may be discharged due to motion sickness but this may not prevent the sailor from serving in the Army.

• RE-1 - Individuals who were fully qualified when last separated and remain qualified for reenlistment.
• RE-1A - Individuals with over 6 years of service for pay. Fully qualified for enlistment. Ineligible to reenlist for 93 days after date of separation.
• RE-1B - Individuals who have not been tested to verify primary MOS during currentterm of service. Fully qualified for enlistment.
• RE-1C - Individuals separated who do not possess scores of 90 or higher in any 3 or more aptitude areas of the ASVAB If tested prior to 1 Oct 1980, or scores of 85 or higher in any 3 or more aptitude areas of the ASVAB if tested on or after 1 Oct 80. Fully qualified for enlistment provided otherwise qualified.
• RE-2 - Individuals separated for the convenience of the Government in accordance with Chapter 5, AR 635-200, (Chapter 5, 6, 8, 9, 11, 12) and reenlistment is not contemplated. Fully qualified for enlistment/reenlistment (AR 635-200.
• RE-2A - Individuals with over 6 years of service for pay who have incurred an additional service requirement and who decline to meet the additional service requirement through reenlistment or extension and were separated prior to 15 Aug 1977. Fully qualified for enlistment. Ineligible to reenlist in grade and for 93 days after date of separation.
• RE-2B - Individuals who were fully qualified when last separated. However, reenlistment not authorized at time of separation under enlisted year group management plan. Fully qualified for enlistment.
• RE-2C - Individuals who were fully qualified when last separated. However, reenlistment not authorized at time of separation under reenlistment control policy.Fully qualified for enlistment.
• RE-3 - Individuals who are not qualified for continued Army service, but the
• disqualification is may be waived. Ineligible for enlistment unless a waiver is granted.
• RE-3A
  • Section 1. Individuals who do not possess scores of or higher in any 3 or more aptitude areas of the AQB or the ACB. However, this code is o longer used for this disqualification. Fully qualified for enlistment if mental requirements of table 2-1 can be met. Prior service mental requirements are may not be waived. Waiver, if approved, is valid only for the purpose of providing continuous, unbroken service for RA in- service personnel.
  • Section 2. Individuals with over 6 years of service for pay who have incurred an additional service equipment and who decline to meet the additional service through reenlistment or extension and were separated on or after 15 Aug 1977. Fully qualified for enlistment. Waiver, if approved, is valid only for the purpose of providing continuous, unbroken service for RA in-service personnel.
• RE-3B - Individuals who have time lost during their last period of service. Ineligible for enlistment unless waiver is granted. (paragraphs 2-7 and 2-8a). Applicable to EM who have time lost during their last period of service.
• RE-3C - Individuals who have completed over 4 months service who do not meet the pay grade requirements of Chapter 2), or who have been denied enlistment under Qualitative Screening Process pursuant to Chapter 4 AR 600-200. Ineligible for enlistment unless waiver is granted. Applicable to persons who have completed over 8 months service who do not meet the prior grade and service criterion of the Qualitative Management Program (AR 600-200 Chapter 4).
• RE-4 - Individuals separated from last period of service with a non-waiverable disqualification (refer to AR 601-280). Ineligible for enlistment except as provided for in paragraphs 2-7c and 2-7d. (See waiverable moral and administrative disqualifications.) Disqualification is non-waivable.
• RE-4A - Individuals who did not meet basic eligibility citizenship requirement of Chapter 2, AR 601-280, at time of last separation from active duty. Ineligible for enlistment unless requirements of table 2-1 can be met. Citizenship requirements are non-waiveable. Applicable to EM who fail to meet citizenship requirements.
• RE-4R - Individuals retiring after 20 or more years active Federal service (title 10, U. S. Code 3914 or 3917) Ineligible for enlistment.
